Terms & Conditions
Last updated: 22 February 2025
1. Acceptance of Terms
By accessing or using the A&E Waiting Times website (the “Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you must not use the Service. We reserve the right to amend these Terms at any time by updating this page. Your continued use of the Service following any changes constitutes acceptance of the revised Terms.
2. Description of Service
The Service aggregates publicly available Accident & Emergency (A&E) waiting time data from NHS hospital trust websites across the United Kingdom. The Service presents this data in an accessible format and provides additional features including driving time estimates, historical wait time trends, and forecasts based on historical patterns. The Service is provided free of charge and on an “as is” and “as available” basis.
3. Not Medical Advice
The Service does not provide medical advice, diagnosis, or treatment. Nothing on this website should be construed as professional medical advice or a recommendation to attend or not attend any particular hospital or emergency department. The Service is an informational tool only. Always seek the advice of a qualified healthcare professional with any questions you may have regarding a medical condition. If you are experiencing a medical emergency, call 999 immediately. Never delay seeking medical attention or disregard professional medical advice because of information displayed on this website.
4. Data Accuracy & Reliability
Waiting time data displayed on the Service is sourced by automated means from publicly available NHS hospital trust websites. While we make reasonable efforts to ensure the data is accurate and up to date, we make no warranties or representations, express or implied, as to the accuracy, completeness, reliability, timeliness, or suitability of any information displayed. In particular:
- Waiting times may change rapidly and the data shown may not reflect current conditions at the time you view it.
- There may be delays between a hospital updating its data and our system reflecting those changes.
- Technical failures, network issues, or changes to hospital websites may result in missing, incomplete, or inaccurate data.
- Forecasts and historical trend data are based on statistical patterns and are not guarantees of future waiting times.
- Driving time estimates are approximate and depend on real-time traffic conditions, road closures, and other factors outside our control.
You should always contact the hospital directly or call NHS 111 for the most up-to-date information before making any decisions about where to seek care.
5. Limitation of Liability
To the maximum extent permitted by applicable law, including but not limited to the Unfair Contract Terms Act 1977, the Consumer Rights Act 2015, and common law:
- The Service, its owners, operators, directors, employees, agents, and affiliates (“we”) shall not be liable for any loss or damage of any kind arising from or in connection with your use of, or inability to use, the Service or any information provided through it, whether based in contract, tort (including negligence), strict liability, or any other legal theory.
- This includes, without limitation, any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses.
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.
In any event, our total aggregate liability to you for all claims arising from or relating to the Service shall not exceed the sum of fifty pounds sterling (£50).
6. Indemnification
You agree to indemnify, defend, and hold harmless the Service and its operators from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to your use of the Service, your violation of these Terms, or your violation of any rights of any third party.
7. Intellectual Property
The design, layout, code, graphics, and branding of the Service are the intellectual property of its operators and are protected by copyright, trademark, and other intellectual property laws of England and Wales. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from the Service without our prior written consent, except as permitted under the Copyright, Designs and Patents Act 1988 (e.g. fair dealing for personal study or research).
Hospital waiting time data displayed on the Service is sourced from publicly available NHS sources. We do not claim ownership of the underlying data published by NHS trusts.
8. Acceptable Use
You agree not to use the Service for any purpose that is unlawful, harmful, or prohibited by these Terms. Without limitation, you must not:
- Use automated tools, bots, scrapers, or crawlers to access the Service or extract data from it without our prior written permission.
- Attempt to interfere with, compromise, or disrupt the Service or its underlying infrastructure.
- Use the Service in any manner that could damage, disable, overburden, or impair it.
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
- Use the Service to transmit any malicious code, viruses, or other harmful material.
- Reproduce, republish, or redistribute waiting time data from the Service for commercial purposes without our written consent.
9. Third-Party Links & Content
The Service may contain links to third-party websites, including hospital websites, NHS services, and other external resources. These links are provided for convenience only. We do not endorse, control, or accept responsibility for the content, accuracy, or availability of any third-party website. Your use of third-party websites is at your own risk and subject to their respective terms and conditions.
10. Service Availability
We do not guarantee that the Service will be available at all times or that it will be free from errors, viruses, or other harmful components. We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time without notice or liability. We shall not be liable for any interruption or cessation of the Service.
11. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If modification is not possible, the provision shall be deemed severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions.
12. Entire Agreement
These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and us regarding your use of the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
13. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
